New York Car Accident Lawyer
If you have been hurt is in accident involving a car, there are two deadlines you need to know.
1. You only have 30 days from the date of the accident to file an application for No-Fault Benefits with the insurance company that insured the car you were in or the car that hit you. No-Fault Benefits are intended to pay your medical bills and part of your lost earnings.
2. In return for paying medical bills and part of the lost earnings for anyone involved in a car accident, your right to sue for the pain and limitations caused by the accident was taken away unless you sustained a “Serious Injury” within the meaning of the Insurance Law §5102, which lists them as:
Death
Dismemberment
Significant disfigurement
Fracture
Loss of a fetus
Permanent (total) loss of use of a body organ, member, function or system (very rare)
Significant limitation of use of a body function or system (does not have to be permanent); or
An injury which prevents the injured person from performing substantially all of the material acts which constitute that person’s usual and customary daily activities for at least 90 days during the first 180 days following the accident
There are many pit falls that you need to be aware of. In New York, a person has three years from the date of the accident to start a lawsuit against another individual or non-governmental entity.
